Like everything else on this planet it is the result of conflict (Those at the bottom, struggling up and those at the top, trying to hold their position) and because of that makes as much sense/ suffers from it; for instance- Compensation? - how much is too much? How little is not enough? Surely we'd be better giving victims free therapy to deal with their emotional loss and a pension for widows to support themselves, so they could look after their children, rather than work their backsides off or physical help to the injured, who survived accident/ crime, appropriate to their needs. Punishment? - pointless as it doesn't turn back the clock, plus as Scientology said when I was involved in it, it leaves the criminal feeling justified in their actions and attitude (World isn't fair/ they deserved it), unless they actually feel guilty about what they did (Gary Gilmore type is different and should be honoured for that as they believe in reparation for sins (errors)). Purpose? - the law should act to stop criminal re-offending (If somebody shoots at the police and won't surrender, then shooting back is the only alternative as jail is for those who won't stop stealing (Addiction by any other name, leads to reckless action - be it the thrill of getting away with theft or murder: Incaceration removes them from temptation and allows the rest of society to get on with its life unhindered/ distracted). Those who want to give up the addiction to crime, should be helped relocate and start up new lives, with new identities plus training for legal employment (Move away from old friends, old lives, old temptations: 'People do not change (mature) until the pain of staying the same, outweighs the pain to alter' (Kick the habit)). Society should run like a well oiled machine (legal science) but not everyone is willing to put in the thought and effort to make it do this or to make the allowances necessary for it to occur either - hence the series of mishaps that passes for the imperfect version that now exists (work in progress). The more we understand about reality and how our own minds work, the more chance we've got of getting there.
