munch Posted July 21, 2006 Report Posted July 21, 2006 I'm by no means a legal expert, but I've spent enough time around hospitals to have a general sense of how this situation would play out. The first topic that comes to mind is the Hippocratic Oath. I know, it doesn't have any laws to enforce it, but a doctor with half a brain will still abide by it. The concept of doing no harm is firmly ingrained into every medical facility I've visited (a lot). If you did decide to side with mom, every doctor you work with would take the case from you. Essentially, no matter what you do, the kid lives. This high-lights one of my major issues with society in this day and age. Not that it was better "back then", but that it can get better. Children are concidered Second class citizens, as Slaves and Women were once concidered. they have essentially no rights, outside of those granted by the Parent or Guardian (got to hope they deserve the titles). The nice thing about living now is that children have a plethora of options for escaping abusive or dangerous situations. In our little scenario, kid can request a social worker, either from the gov't or from the hospital, who can help either reconcile with mom or, more likely, find another guardian. If it turns out that everyone -- family, friends, neighbors -- wants him dead, kid can become a ward of the state. And don't forget legal options. All he needs to do is appeal to the state or someone willing to file suit against anyone -- probably mom, but it literally could be anyone. Then he just needs to delay until his birthday. Or he could appear on Oprah. That'd guarantee him a free pass until he's 18. Children may not have as much power as they should, but in cases of life and death, they have enough.
